caught speeding!

well as it says in the title, i got caught driving in excess of the speed limit on the 13-6-05, they did not tell me the speed as it is a breach of the data protection act until i agree that it was myself driving.

not gonna kick and moan too much but is there any way i can get out of it this really is the last thing i need. i have a feeling that i was only doing about 35 in a thiry and the copper that got me smercked as i drove past. the van was disguised as a motor way maintenance van from the rear. I HATE the police all they do is cause me greif they were round my parents house too the other day after some old buggers had complained about my exhaust FFS.

i need to get out of this on as my record so far iisnt great. please please help with any suggestions of sources of information so i can try and wriggle my way out.

any help or pointers VERY much appriciated.

You were speeding, none of the rest of what you said makes any difference to the law. Not really anyway out of it.
 
yep sorry mate no way out,

the police have way more resorces that you do if you ever decide to argue the ticket,
 
ther is away out,,deffinatly,take it to court get a gud brief that specialises in trafic offences etc,

if they copper cant prove he calibrated the speed gun before and after use thats a reason to get away with it,,
i swaped cars with my mate so he could see wot it was like,,he had no insurance on my car,and got caught doing 77mph on a 40mph road,,he took it to court and didnt get a fine or points,,
 
interesting their rik, i will look into that cheers.

and im guessing that they basically never re-calibrate before and after use.

even if he did he would have any way to prove it would he?
 
thats it basicly yeah,also it must be visable for a certain distance and mafked as a camera/police van,,and the copper shuld be wearing his white hat and his yellow vizzy vest(wen its a hot day they tend to take these off),,

ther are sum websites around telling you all these things but i dont know any,,try google
 
too many of us getting caught speeding people... limits are there for a good reason. i know whats its like to be on the wrong side of a speeding bumper and it aint a barrel of laughs

plus... no point telling me what ian does, im not him

in reference to when i speed, i dont do it in housing estates etc
but i dun have to explain myself to you Mr Uberspeedo :p

and have you seen the new things that light up when you are going over the limit? much better idea, no pics taken plus most of time when caught on them you only doing a few miles over and havent noticed.
 
They don't have to be visible. And clearly they are all trained to comply with the law to make successful prosecutions, otherwise what would be the point?
 
so why are so many people getting let off each day??

yes they DO have be visable,,or why dont they hide in trees,and bushes and were camoflage????

they may well be trained to comply with the law and to make successful prosecutions but the point rik has made and is a very good one, a loophole almost is how do they prove they complied. evidence is everything in british law and im innocent until proven guilty.

i see your point that they are their to do a job but what if they made a mistake whilst doing it, we all make mistakes and they are only human. thanks for the pointers rik im gonna have a search around and see what i can dig up.

Yeah I got caught doing 37mph too not so long ago. Didn't do anything about it as it was my first one, but the van didn't have any markings on the front, which kinda annoyed me, but still not much I could do about it. :(

If you'd bothered finding a decent, first hand source of information, you would have seen that the first part of the quote is from the Association of Chief Police Officers Guidance Manual. There is absolutely nothing in Road Traffic Act, or any other piece of legislation, to say that a speed trap or speed camera need be visible. There are guidelines that say that, but they have no holding in a court.

Calibrating a speed trap only takes a few minutes, and they are used for a whole shift. I'm pretty sure that Surrey Police even have a form specifically for doing this, so I would presume that other forces do to. It's not very likely that they didn't do it.
 
If you look into the equipment I have on my corolla then it will make your life driving much easier! Road Pilot for fixed gasto camera's and laser diffusers for anything mobile.

I don't drive around like a nutter, speeding all the time, but yes like many on here I do occasionally go over the limit and my lifestyle means I'm rushing about a lot with everything I cram into a busy week and it does happen.

Yeah i think the only way you can shift a penalty may be down to a technicality.. you mention above about the cameras being calibrated. If the meat wagon has an in car video then evidence of calibration and your speeding will be on that. If its some guy at the side of the road with a laser, then you might be more fortunate.

Will be getting me some laser diffusers tho! been on my shopping list a while now
